Below we’ve summarized the regulatory updates related to testing. Please note that this is just a brief overview of the regulatory changes. January 8, 2024 – Reduced Testing Allowance (RTA) updates:
- Prior to starting RTA, an attestation form and certification fee will need to be submitted to the MED.
- If you have achieved RTA prior to January 8, 2024, you will have until January 31, 2024 to submit the attestation form and fee.
- The RTA certification fee is license-specific.

July 1, 2024 – RTA Microbial Contaminant Testing updates:
HACCP System
- Effective July 1, 2024, to achieve or maintain RTA for Microbial Contaminant testing, Cultivation Facilities must have a Hazard Analysis and Critical Control Point (HACCP) System in place.
- A HACCP System will be required for each product type that a licensee would like to achieve RTA for Microbial Contamination.
RTA Internal Audit
- Effective July 1, 2024, to achieve or maintain RTA for Microbial Contaminant testing, Cultivation Facilities must conduct an internal audit to make sure they are complying with the RTA rule requirements.
- A passing score is 80%.
- The MED will provide guidance and a standard audit checklist in early 2024.
Other Updates:
- “RFID” tags have been renamed “Inventory Tracking System” tags.
- Seeds, clones, and genetic material can now be acquired from an expanded list of approved sources.
- Approved techniques listed in the regulations for Microbial Control Steps and Decontamination.
- Hospitality and Sales businesses will have daily sales limits, provide safe transportation, and prevent overconsumption.
